Once found primarily in the entertainment industry, the artificial intelligence (AI) technology used to create deepfakes has become increasingly sophisticated, affordable, and user-friendly. Widespread access to the technology that allows studios to de-age actors makes it easy for inexperienced users to create convincing digital media. A few clicks can transform a white paper into an audio podcast or educational video featuring realistic synthetic actors. These tools can also replicate the voices of political leaders, a tactic used in a scam that extracted more than a million euros.

When used as a transparent tool in the courtroom, AI can create accident reconstruction videos and assist with expert analysis. However, AI-generated or AI-manipulated evidence meant to deceive a judge and/or jury is a very serious and growing concern.
In a recent child custody case that NGH was involved in, a woman submitted digital audio recordings to the court that allegedly captured her former spouse making hateful statements. If authentic, the recordings could have damaged the man’s professional reputation, jeopardized his parental rights, and harmed his relationship with his children. Forensic analysis and expert submissions by NGH identified red flags leading to court-ordered forensic examinations, which ultimately prompted the woman to admit she had manufactured the recordings with voice-cloning AI technology.
